Notice is hereby given, pursuant to Section 13 (6) of the Planning & Development Act 2000 (as amended) that Kerry County Council being the Planning Authority of the County of Kerry, proposes to make alterations to Proposed Variation No. 1 of the Kerry County Development Plan 2022–2028 which includes the following, Tralee Municipal District Settlement’s Plan, Tralee Local Transport Plan (LTP) and Strategic Flood Risk Assessment (SFRA) for the Tralee Municipal District Settlements’ Plan. The proposed alterations would, if made, be a Material Alteration of Variation No. 1 of the Kerry County Development Plan 2022-2028.
In accordance with Section 13(6) of the Planning & Development Act 2000 (as amended) the Planning Authority has determined:
That a Strategic Environmental Assessment of one or more of the proposed material alterations was required; and
That following the preparation of a Habitats Directive Assessment Screening Exercise, a Stage II Appropriate Assessment of one or more of the proposed material alterations was required.
In this regard, the following documents are published for inspection and public consultation:
Proposed Material Alterations to Proposed Variation No. 1 of the Kerry County Development Plan 2022-2028.
Strategic Environmental Assessment Addendum Report pursuant to the SEA Directive and Planning and Development (Strategic Environmental Assessment) Regulations 2001 (as amended) containing an assessment of the Proposed Material Alterations.
Habitats Directive Assessment Natura Impact Report Addendum Report pursuant to the EU Habitats Directive (92/43/EEC) and Planning & Development Act 2000 (as amended) containing an assessment of the Proposed Material Alterations.
An update to the Strategic Flood Risk Assessment (SFRA) pursuant to Section 28 of the Planning & Development Act 2000 (as amended), containing an assessment of the Proposed Material Alterations.
Copies of the proposed Material Alterations to Variation No. 1 of the Kerry County Development Plan 2022-2028 may be inspected from Thursday 5th June 2025 until Friday 4th July 2025.
(both dates inclusive) at the following locations:
Room 13, Planning Department, County Buildings, Rathass, Tralee
Pursuant to the Strategic Environmental Assessment Directive (2001/42/EC) and the Planning & Development [Strategic Environmental Assessment] Regulations 2001(as amended), information on the likely significant effects on the environment of implementing the proposed material alterations will also be available for inspection at the above dates and locations.
Pursuant to Article 6 of the Habitats Directive 92/ 43/EEC, the Habitats Directive Natura Impact Report Addendum Report on the proposed material alterations is similarly available for inspection.
Pursuant to Section 28 of the Planning and Development Act 2000 (as amended), an update to the Strategic Flood Risk Assessment of the Proposed Variation No. 1 has also been prepared.
