Proposed Variation No 4 of the Kerry County Development Plan 2022-2028

Notice is hereby given, pursuant to Section 58 of the Planning & Development Act 2024 that Kerry County Council being the Planning Authority of the County of Kerry, has prepared a Proposed Variation of the Kerry County Development Plan 2022 – 2028 in respect of the following:

Proposed Variation No. 4 –  Listowel Municipal District Settlements' Plan, which will replace the Listowel Town Development Plan as contained in Volume 2 (Town Development Plans) of the Kerry County Development Plan (KCDP) 2022 - 2028 and also the Listowel Municipal District Local Area Plan 2020-2026.  The Municipal District includes the following settlements:

Regional Towns	Ballybunion, Listowel
District Towns	Ballyheigue, Ballylongford, Tarbert
Villages	Abbeydorney, Ballyduff, Causeway, Duagh, Kilflynn, Lixnaw, Moyvane
Small Village Settlements	Asdee, Finuge, Kilmoyley, Knockanure, Lisselton

Reason for Proposed Variation No. 4:  The Proposed Variation will provide a settlement plan for the Listowel Municipal District Area, replacing the Listowel Town Development Plan as contained in Volume 2 of the KCDP 2022-2028 and the Listowel Municipal District Local Area Plan 2020-2026. The settlements’ plan includes a written statement and mapped objectives to provide a comprehensive local planning framework with clear policies and objectives including land use zoning, in the interests of the common good. The settlements’ plan completes the planning framework for the area and complements the current National, Regional and County policies and objectives.

Submissions or observations on the Proposed Variation No. 4 are hereby invited from the public and interested bodies. Children, or groups or associations representing the interests of children, are entitled to make submissions or observations. All written submissions or observations will be duly considered by the Planning Authority and taken into consideration before the making of the proposed variation.

Submissions may be made during the period from Thursday 16th April until Friday 15th May 2026. 

Pursuant to the Strategic Environmental Assessment Directive (2001/42/EC) and the Planning  &  Development  [Strategic  Environmental Assessment] Regulations 2004 (as amended) the Planning Authority has undertaken a Strategic Environmental Assessment of the Proposed Variation No. 4.

Pursuant to Article 6 of the Habitats Directive 92/43/EEC the Planning Authority has undertaken an Appropriate Assessment and prepared a Natura Impact Report for the Proposed Variation No. 4.

Pursuant to  Section  27  of  the  Planning  and  Development  Act  2024 , a Strategic Flood Risk Assessment of the Proposed Variation No. 4 has also been prepared.

The proposed variation is accompanied by a Strategic Environmental Assessment Environmental Report setting out the likely significant effects of implementing the proposed variation, a Habitats Directive Assessment Natura Impact Report which assesses the potential for impact on Natura 2000 sites and a Strategic Flood Risk Assessment Report.  Submissions or observations in respect of the Environmental Reports made to the Planning Authority within the period specified in the notice will also be taken into consideration before the making of the proposed variation.

Copies of the Proposed Variation, together with the Strategic Environmental Assessment Report, Habitats Directive Assessment Natura Impact Report and the Strategic Flood Risk Assessment Report may be inspected from Thursday 16th April until Friday 15th May 2026.

Cuirfidh plean na lonnaíochtaí leis an gcreat pleanála don cheantar agus leis na beartais agus cuspóirí Náisiúnta, Réigiúnacha agus Contae atá i bhfeidhm faoi láthair.

Fáiltítear anois roimh aighneachtaí nó tuairimí maidir le hAthrú Beartaithe Uimh. 4 ón bpobal agus ó chomhlachtaí leasmhara. Tá leanaí, nó grúpaí nó cumainn atá ionadaitheach do leasanna leanaí, i dteideal aighneachtaí a dhéanamh agus tuairimí a thabhairt. Breithneoidh an tÚdarás Pleanála gach aighneacht nó tuairim scríofa go cuí agus cuirfear a leithéid san áireamh sula ndéanfar an tAthrú Beartaithe.

Is féidir aighneachtaí a dhéanamh i rith na tréimhse idir an Déardaoin, an 16ú Aibreán agus an Aoine, an 15ú Bealtaine 2026.

De bhua na Treorach maidir le Measúnacht Straitéiseach Timpeallachta (2001/42/CE) agus na Rialachán um Pleanáil & Forbairt  [Measúnacht Straitéiseach Timpeallachta], 2004 (arna leasú), rinne an tÚdarás Pleanála Measúnacht Straitéiseach Timpeallachta ar Athrú Beartaithe Uimh. 4.

De bhua Airteagal 6 den Treoir maidir le Gnáthóga 92/43/CEE, rinne an tÚdarás Pleanála Measúnacht Chuí agus d’ullmhaigh sé Tuarascáil Tionchair Natura d’Athrú Beartaithe Uimh. 4.

De bhua Alt 27 d’Acht um Pleanáil agus Forbairt, 2024, tá Measúnú Straitéiseach ar Riosca i gCás Tuilte ar Athrú Beartaithe Uimh. 4 ullmhaithe freisin.

I dteannta leis an athrú beartaithe tá Tuarascáil Chomhshaoil bunaithe ar an Measúnacht Straitéiseach Timpeallachta ina leagtar amach na héifeachtaí is dócha a bheidh ag an Athrú Beartaithe a chur chun feidhme, Tuarascáil Tionchair Natura Mheasúnacht na Treorach maidir le Gnáthóga ina ndéantar measúnú ar an bhféidearthacht a bhaineann le tionchar ar láithreáin Natura 2000 agus Tuarascáil ar Mheasúnú Straitéiseach ar Riosca i gCás Tuilte. Chomh maith leis sin, cuirfear san áireamh aighneachtaí nó tuairimí maidir leis na Tuarascálacha Timpeallachta a cuireadh faoi bhráid an údaráis phleanála laistigh den tréimhse atá sonraithe san fhógra sula ndéanfar an tAthrú Beartaithe.
